Commissioners Minutes
July
5, 2007
The
Board of Adams County Commissioners met this day with the following
present: Vice-Chairmen Mike
Paradis, Commissioner Joe Holmes, Clerk Sherry Ward, Warren Rice and
Robin James, Appraisers, Cliff McLean, State Tax Commission and Karen Hatfield,
Assessor. Celeste Zielinski
from the Record joined the meeting.
Whereas
the following proceedings were had, to-wit:
Joe
Holmes made a motion to move into the Board of Equalization. The motion was seconded by Mike
Paradis and passed unanimously.
JIM
PENNE: Parcel
RP15N01W363001A. Mr. Penne
and Fran Villano present to discuss the assessment increase on
improvements of $8,809.00.
Mike Paradis started the conversation by saying the State Tax
Commission required the County to stay within 90-110% of market
value. Mr. Penne presented
the Board with actual costs of the decking of $6,746.62. Robin James presented costs she
researched by calling Lowes regarding decking and also stating the
information the County has needs to be updated with the new decking such
as Lowes Choice Composite decking.
Joe Holmes made a motion to approve the change in market value to
$6,746.62 from $8,809.00 due to proof of actual costs. The motion was seconded by Mike
Paradis and passed unanimously.
JOHN
HUCKS: Parcel RP001200000100A. Mr. Hucks stated the County is
illegally attempting to revoke a Forestland Designation prior to its
statutory expiration date.
The property is in a Forest Management Plan. Mr. Hucks stated in 2005 he
purchased the property. Mr.
Hucks has made no improvements until 2007 when he planted seedlings. January of 2007 he received a
letter from the Assessor’s office revoking Forest Management Plan. Mr. Hucks said the plan should
remain in effect for 10 years and believes he is still entitled to the
timber exemption. Mr. Hucks
received a letter from Karen Hatfield in 2006 stating the timber
exemption would be good for the next ten years. Mr. Hucks said the statute states if it has not
changed the timber exemption should still stay in affect. Karen said we require the new
owner has to present a new management plan. Myron Gabbert, Prosecuting Attorney, joined the
meeting via telephone conference.
Myron said he has reviewed the State statutes, the information
Karen gave him and determined that the Assessor is correct in taking the
timber exemption off of the 19.1 total acres. Joe Holmes made a motion to allow 5.1 acres to be
under the timber management plan, Category 16, value $737.00 and 14.81,
Category 15, with a value of $290,276.00. The motion was seconded by Mike Paradis and passed
unanimously. The Clerk gave
John Hucks the form to appeal to the State Tax Board.
BRUNDAGE
SKI RESORT: Gary
Blaylock, Judd DeBoer and Rick Certano were present. Joe Holmes made a motion to move
into Executive Session pursuant to 67-2345. The motion was seconded by Mike Paradis and passed
unanimously.
Joe
Holmes made a motion to move out of Executive Session and resume the
regular meeting. The motion
was seconded by Mike Paradis and passed unanimously. A continuance was granted until
Monday, July 9, 2007 at 11:00 am for more information to be gathered and
reviewed.
KIRT
AMBROSE: Parcel
RP16N01W113708A. Continuance
from June 27, 2007. Kirt and
Sandra Ambrose were present to finalize assessment. Sandra gave Karen Hatfield a list
of people she called for values.
Kirt said an appraiser would not come to appraise their pre-HUD
home. Karen said the State
Tax Commission said the package deal of land and mobile home is why the
value is higher. The Board
agreed on a final value of $6,717.00 for the home and no change on the
improvements. Joe Holmes
made a motion to change the value to $6,717.00. The motion was seconded by Mike Paradis and passed
unanimously.
July
5, 2007 – Continued:
MINUTES: Joe Holmes made a motion to
approve the minutes for the June 27, 2007 Board of Equalization with two
changes. The motion was
seconded by Mike Paradis and passed unanimously.
MISCELLANEOUS
CHANGES TO VALUES: Karen
Hatfield prepared some Board of Equalization adjustments. Joe Holmes made a motion to allow
the reductions as presented and listed. The motion was seconded by Mike Paradis and passed
unanimously.

WES
PORTER: Wes Porter is
building on one of his own lots in the Walker Ranch Subdivision. Mike Paradis stated Mr. Porter
did not have to pay the $23,500.00 to the County for road maintenance due
to the fact it was his own property and that the property was not
sold. Joe Holmes and Mike
Paradis want to make sure it is not counted in the 20 lots and that it
does not preclude the agreement and the agreement is still valid. The Board directed the Clerk to
prepare a letter to Mr. Porter.
With
no further business to come before the Board the Board recesses until
July 9, 2007.
