Commissioners Minutes

The Board of Adams County Commissioners met this day with the following present:  Chairman Bill Brown, Commissioners Mike Paradis and Joe Holmes and Clerk Sheriff Ward, Building Inspector Don Horton and Pam Murphy and concerned citizens from the Council area.

 

Public hearing on zone change for Larry Walker (Walker Research) located off Goodrich Road north of Hidden Canyon Subdivision from Agriculture/Timber/Grazing (ATG) to Rural Residential (R-1).

 

Whereas the following proceedings were had, to-wit:

 

Chairman Brown opened the special meeting on Larry Walker (Walker Research) stating how the meeting will be conducted starting with a brief description of the property, then allowing the developer to talk and finally the concerned citizens will be allowed to ask questions.

 

After Building Inspector Don Horton gave a description of the property Tony Bernardo, Stewart Land Group representative for Larry Walker, passed pictures of the proposed subdivision.  Lot total to be approximately 74.  An access through Barb Maas property is being looked at, a second access is through the Hidden Canyon Subdivision.  Bill said it is just a conceptual idea at this stage.  If conditions are set for rezone to be approved a one-year term will be put in place.  Bill said please remember the subdivision must fit in Adams County’s comprehensive plan.  The preliminary plat stage will be the opportunity for more questions and answers.

 

Bill Gamble stated he is pleased to see other concerns on the impact of the aquifer; would like some assurance from Tony Bernardo that water testing will be done to determine the impact of more property owners in the area.

 

Wayne Burkhardt stated the rezone needs to be taken seriously, concerns over high density in an agriculture zone and placing subdivision here and there creating a leapfrog development.

 

Bill said the Board sees the importance of steering building in high-density area, but on the other side is the personal property rights.

 

Russell Mink stated he is opposed to the rezone; he grazes cattle in the Goodrich area.  Without rezone three pieces greater than 40 acres, no more than four houses.

 

Julie Burkhardt said if the property is rezoned to R-1 she is not in favor of acreages less than 20 parcels for 2/3 of the property.  Mike Paradis said more issues would be addressed during the preliminary plat time frame, no rubber stamp.  The developer needs to rethink, spend money to study further.  Mike said due to the terrain, the lot sizes would need to be increased.

 

Shawn Stanford joined the hearing

 

Tony Bernardo said we are in the concept stage.

 

Mike Paradis said good fire protection; ponds, wells along access for fire engineers.

 

Mike Nourse said they have two firemen in Goodrich, Mesa/Indian Valley will respond.

 

Don Horton said comprehensive plan is for open space/rural life style, developing lots to fit the property.  A five-acre minimum is in the comprehensive plan but the lay of the land dictates how many lots and size.  The County doesn’t want the land to be chopped up to get five-acre parcels; we want the developer to think ahead by slowing the process down.

 

Wendy Green asked what are the options for the developers?  Bill said if not in the direction of the comprehensive plan then the developer needs to go back to fit the concept.

 

Tony Bernardo said he is not sure why all the questions, it is just a rezone.  Don said concept plan gives opportunity to slow down the process.  Mike said issues need to be out in the open now for the developers to address.

 

Julie Irish, Hidden Canyon property owner, have lived in McCall for 17 years, she is happy the process is slowed down.

 

Julie Burkhardt stated a person has no rights in rezone; why are we considering rezone, does not make sense to rezone one landowner’s property.

 

Mark Silfka, Hidden Canyon property owner, moved to the area because he likes the open space concept.  The proposed subdivision will impact views, open space and water.  Mark, a retired geologist, stated just because permits are issued, water could dry up.  Water tables are hard to determine but can be done, Idaho Department of Water Resource can do studies.

 

Mike Nourse, Fire Chief for Indian Valley and Goodrich, stated more people are coming to the area and will want services such as fire and water.  The fire department lacks people to do the job; we cannot guarantee level of services.  Mike Paradis said building permits last year are up 50%, people census down 1.6%.  Mike Nourse said more people cause fires and more roads bring in noxious weeds.

 

Janet Fields asked if the County could require a substation?

 

Mike Nourse asked if all would be rezoned or partial, all would be either rezoned or not.

 

Toni Bernardo stated work will be in phases and would be market driven.

 

Julie Burkhardt said ultimately we the taxpayers would have to pay for growth.  Mike Paradis said the increase in services would have to increase taxes.

 

Wendy Green stated private property issues increase taxes and decrease services and she asked the Board to use caution in addressing rezone.

 

Ed Fields addressed water concerns, infrastructure will need to grow and no more dust.

 

The hearing will be held open to receive additional written comments.
